1. Release & Waiver of Liability
The Participant, on behalf of themselves and their heirs, executors, administrators, successors, and assigns, hereby irrevocably waives, releases, and discharges 102190362 Saskatchewan Ltd. (District 306), its officers, directors, shareholders, employees, contractors, agents, affiliates, successors, and assigns (the "Released Parties") from any and all claims, demands, liabilities, damages, losses, costs, or expenses of any kind arising out of or related to participation in axe throwing, rage room, and/or any other activities at District 306, including but not limited to personal injury, death, or property damage, howsoever caused, including negligence.
2. Assumption of Risks
The Participant acknowledges that the Activities involve significant and inherent risks including: throwing axes or similar objects; handling or breaking glass, ceramics, electronics, or other materials; flying debris, sharp fragments, and impact injuries; slips, trips, and falls; equipment malfunction or misuse; physical exertion, stress, or shock; negligence of other participants or staff. These risks may result in serious injury, permanent disability, or death. The Participant voluntarily accepts and fully assumes all such risks.
3. Medical Fitness
The Participant confirms they are physically and mentally capable of safely participating. Participation is not recommended for individuals with asthma, epilepsy, cardiovascular conditions, hypertension, joint injuries, or pregnancy. The Participant agrees not to participate while under the influence of alcohol, drugs, or narcotics.
4. Indemnification
The Participant agrees to indemnify and hold harmless the Released Parties from any and all claims arising from the Participant's participation, actions, omissions, or breach of this Agreement.
5. Compliance with Rules
The Participant agrees to follow all safety rules and instructions provided by staff at all times. Failure to comply may result in removal without refund.
6. Minor Participation
If signing on behalf of a minor, the signer confirms they are the parent or legal guardian of said minor(s), have read and understood this waiver in full, and consent on behalf of each minor to all terms herein. The guardian accepts full responsibility for each minor during their time at District 306.
7. Multimedia Release
The Participant grants District 306 a perpetual, worldwide, royalty-free license to photograph, record, and use their image, voice, and likeness for promotional and marketing purposes in any media, without compensation.
8. Governing Law
This Agreement is governed by the laws of the Province of Saskatchewan. Any disputes shall be resolved by binding arbitration in Regina, Saskatchewan under the Arbitration Act (Saskatchewan).
9. Entire Agreement
This Agreement constitutes the entire agreement between the parties and supersedes all prior communications. If any provision is found unenforceable, remaining provisions remain in full force.
